    • By accessing or using the website of Fuel Software Control (hereinafter referred to as “the Site”), you agree to be bound by these Terms and Conditions of Use (“Terms of Use”). If you do not agree with these terms, you must refrain from using the Site. Your continued use of the Site constitutes your express consent and agreement to any updates or changes to these Terms of Use.
  • User Obligations on the Mobile Application:

    • Users are responsible for providing accurate and up-to-date information at all times. Unauthorized modifications of data or the use of manipulated photos constitute a violation of these Terms and may result in account suspension or cancellation.
    • Fuel Software Control reserves the right to permanently block the mobile application in cases of misuse without prior notice.
    • Fuel Software Control isn't responsible for internet connection issues, mobile device failures, or errors resulting from the improper use of the application.
  • Use and Protection of Personal Data:

    • In accordance with applicable U.S. and Canadian privacy laws, Fuel Software Control will be responsible for managing personal data collected via the mobile application, website, and payment methods. Personal data will be handled according to the Privacy Policy, which users are notified of in advance. Users have the right to access, correct, and object to the processing of their data.
    • Data such as GPS location, fuel consumption, and electronic receipts collected by the app will be used exclusively to optimize fleet operations. Under no circumstances will this data be sold or shared with third parties without explicit user consent, except as permitted by law.
    • Fuel Software Control ensures that any international data transfers comply with legal requirements, guaranteeing that the recipient country provides adequate levels of protection.
  • Payment Methods Using Credit Cards:

    • Fuel Software Control does not retain users' financial data. Payments made via the platform with physical credit cards are subject to the security policies of banking institutions and third-party payment processors under contract with Fuel Software Control.
    • In case of system failures during payment processing, Fuel Software Control is not responsible for delays or errors caused by third-party payment networks.
    • If a user loses their credit card or encounters issues, Fuel Software Control commits to facilitating card replacement or an alternative mechanism within 48 business hours. However, users are responsible for reporting anomalies to their respective banking institution.
  • User Responsibility for Website Use and Account Security

    • Users are responsible for maintaining the confidentiality of their login credentials. All activities conducted under their account are their sole responsibility. If unauthorized account use is detected, users must notify Fuel Software Control immediately.
    • Fuel Software Control is not liable for damages or losses resulting from misuse of user credentials and reserves the right to suspend accounts involved in suspicious activities or violating these Terms.
  • Intellectual Property Rights

    • All content, software, and technology used by Fuel Software Control on the website or mobile application is the exclusive property of Fuel Software Control and is protected under U.S. and Canadian intellectual property laws. Unauthorized reproduction, distribution, or use of content will be penalized under the law.
    • Fuel Software Control may block and take legal action against users who infringe upon these rights.
  • Disclaimer of Warranties and Limited Liability

    • Fuel Software Control provides its services "as is" and "as available." No guarantees are made regarding error-free or uninterrupted services, especially in cases of factors beyond the company’s control, such as internet infrastructure failures, natural disasters, or issues with external service providers.
    • Fuel Software Control is not responsible for data loss, service interruptions, or economic damages arising from technical failures not directly attributable to its platform.
  • Dispute Resolution

    • In case of disputes or claims related to the platform or services, the parties agree to submit to the jurisdiction of the courts in the applicable U.S. or Canadian region. These Terms will be interpreted in accordance with applicable U.S. and Canadian laws, including consumer protection and privacy regulations.
    • Fuel Software Control will offer alternative dispute resolution mechanisms but reserves the right to protect its interests through judicial means.

    • Fuel Software Control reserves the right to modify these Terms at any time. Changes will be communicated to users through registered contact methods, and continued use of the platform constitutes acceptance of the revised Terms.
